Order No. 42 of the Ministry of education of the people's Republic of China, the Ministry of foreign affairs of the people's Republic of China and the Ministry of public security of the people's Republic of China

In accordance with laws and regulations and department management responsibilities, the Ministry of education, the Ministry of foreign affairs and the Ministry of Public Security jointly formulated the administrative measures for schools to recruit and train international students. It is hereby promulgated and shall come into force as of July 1, 2017.

Administrative measures for the recruitment and training of international students by schools

general provisions

1. These measures are formulated in accordance with the education law of the people's Republic of China, the law of the people's Republic of China on the administration of exit and entry and other laws and regulations for the purpose of standardizing the behavior of schools in recruiting, cultivating and managing international students, facilitating the study of International students in schools in China, enhancing educational exchanges and cooperation with foreign countries and improving the internationalization level of Chinese education.

2. The term "schools" as mentioned in these Measures refers to schools that implement preschool education, primary education, secondary education and higher education within the territory of the people's Republic of China.

The term "international students" as mentioned in these Measures refers to foreign students who do not have Chinese nationality and receive education in schools in accordance with the nationality law of the people's Republic of China.

Chapters 2 to 5 of these Measures apply to colleges and universities. For schools implementing preschool, primary and secondary education, their enrollment, teaching and internal management of international students shall be implemented in accordance with the provisions of provinces, autonomous regions and municipalities directly under the central government.

3. When recruiting and cultivating international students, schools shall abide by Chinese laws, regulations and national policies; We should safeguard national sovereignty, security and social and public interests; It shall standardize management and ensure quality.

International students should abide by Chinese laws and regulations, respect Chinese customs, abide by school rules and regulations and complete school learning tasks.

4. The administrative department of Education under the State Council shall be responsible for the overall management of the work of international students throughout the country, formulate macro policies for the recruitment and training of international students, guide and coordinate the educational administrative departments and schools of the people's governments of provinces, autonomous regions and municipalities directly under the central government in the work of international students, and may entrust relevant units and industrial organizations to undertake the management and service of international students.

The foreign affairs, public security and other administrative departments of the State Council shall do a good job in the management of international students according to the division of responsibilities.

5. The education administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government shall guide, coordinate and supervise the work of international students within their respective administrative areas, and shall be responsible for studying and formulating relevant policies on the work of international students at the stage of preschool, primary and secondary education within their respective administrative areas.

The foreign affairs, public security and other administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government shall do a good job in the management of international students according to the division of responsibilities.

6. Schools that recruit international students shall establish and improve the system of recruitment, training, management and service of international students, and be specifically responsible for the recruitment and training of international students.

Chapter II enrollment management

7. Institutions of higher learning shall, in accordance with the relevant provisions of the state, recruit international students and cultivate their independent teaching ability.

8. Institutions of higher learning that recruit international students shall put on record in accordance with the matters and procedures prescribed by the administrative department of Education under the State Council.

9 .Institutions of higher learning recruit international students and receive academic education in the following categories: junior college students, undergraduates, postgraduates and doctoral students; The categories of non academic education are: preparatory students, advanced students and graduate scholars.

10. Colleges and universities shall independently determine the enrollment plans and majors of international students in accordance with their school running conditions and training ability, unless otherwise stipulated by the state.

11. Institutions of higher learning shall, in accordance with the national enrollment regulations, formulate and publish their own enrollment brochures for international students, and recruit international students in accordance with the conditions and procedures specified in the enrollment brochures.

12. Institutions of higher learning shall examine the admission qualifications and financial guarantee certificates of foreign citizens who apply for registration, and conduct examinations or examinations. The admission of international students is decided by the University; The school shall not recruit those who do not meet the enrollment conditions.

13. With the consent of the original enrollment school, an institution of higher learning may accept international students admitted or transferred by other schools.

14. The charging items and standards of colleges and universities for international students shall be implemented in accordance with the relevant provisions of the state.

Institutions of higher learning shall publicize the charging items and standards for international students and the provisions on the refund of dropping out and transferring. Charges and refunds are denominated in RMB.

Chapter III teaching management

15. Colleges and universities shall incorporate the teaching plan for international students into the overall teaching plan of the University, select teachers suitable for the teaching of international students, and establish and improve the guarantee system of education and teaching quality.

16. International students shall take part in the course study in accordance with the curriculum arrangement and teaching plan of colleges and universities, and shall take part in the corresponding graduation examination or examination in accordance with the regulations. The school shall truthfully record its academic achievements and daily performance.

Chinese and the general situation of China should be taken as compulsory courses in higher academic education; Political theory should be a compulsory course for international students majoring in philosophy and political science.

17. After international students enter the University, they can change their majors with the application of students and the consent of colleges and universities. The conditions and procedures for transferring to a major shall be prescribed by the school.

18. The spoken and written language commonly used in the people's Republic of China is the basic teaching language for colleges and universities to train international students. The school can provide necessary remedial conditions for international students whose level of the national common language can not meet the learning requirements.

19. Qualified institutions of higher learning may offer professional courses in foreign languages for international students. For international students who use foreign languages to receive higher education for academic qualifications, their dissertation can be written in corresponding foreign languages, and the abstract of the dissertation shall be in Chinese; Whether the thesis defense uses a foreign language shall be determined by the University.

20. Institutions of higher learning shall organize international students to participate in teaching practice and social practice in accordance with the teaching plan, and the selection of places for practice and practice shall comply with the relevant provisions of the state.

21. Institutions of higher learning shall issue academic certificates or other academic certificates to international students in accordance with the relevant provisions of the state. For international students receiving higher academic education, institutions of higher learning shall handle electronic registration of student status and graduation certificate in time.

Colleges and universities issue degree certificates to international students who meet the conditions for degree awarding.

Chapter IV school management

22. An institution of higher learning shall specify the working organization responsible for the management of international students, which shall be responsible for the overall planning and coordination of the recruitment, teaching, daily management and services of international students, as well as the contact with alumni after graduation.

23. Institutions of higher learning shall disclose to international students the basic information of the University, education and teaching, general rules for enrollment and the management and service system for international students, so as to facilitate international students' access to information.

24. Institutions of higher learning shall provide international students with necessary living service facilities such as accommodation, establish, improve and publicize the management system for the use of service facilities. If international students live outside the school dormitory, they shall go through the registration formalities with the Public Security Department of their residence in time.

25. Institutions of higher learning shall educate international students in Chinese laws and regulations, school disciplines and rules, national conditions, excellent Chinese traditional culture and customs, so as to help them become familiar with and adapt to the learning and living environment as soon as possible.

Colleges and universities shall set up the post of international student counselor, understand the learning and living needs of international students, and provide timely services in terms of information, consultation, cultural and sports activities. The proportion of international student counselors shall not be lower than that of Chinese student counselors, and enjoy the same treatment as Chinese student counselors.

26. Institutions of higher learning encourage international students to participate in recreational and sports activities beneficial to their physical and mental health and provide convenient conditions for them to participate in recreational and sports activities. International students can voluntarily participate in public welfare activities and celebrations of major festivals in China.

Colleges and universities generally do not organize international students to participate in military training and political activities.

27 .With the consent of colleges and universities, international students may hold activities to celebrate their important traditional festivals in the designated places and areas of the University, but they shall not have words and deeds that oppose or attack other countries or nationalities or violate public morality.

28. With the approval of the University, international students may establish fellowship groups in the university to carry out activities within the scope prescribed by Chinese laws and regulations, and accept the guidance and management of the University.

29. Institutions of higher learning shall respect the national customs and religious beliefs of international students, but shall not provide places for religious activities. No missionary, religious gathering or other religious activities are allowed in the school.

30. International students may participate in work study activities during their study in Colleges and universities, but shall not be employed, engaged in business or engage in other business activities.

The specific regulations on the administration of work study for international students shall be formulated separately by the administrative department of Education under the State Council in conjunction with relevant departments.

31. Institutions of higher learning shall carry out the management of international student status with reference to the provisions on the management of Chinese student status. If a school withdraws from school or expels an international student from school, it shall put it on record in accordance with the provisions of the administrative department of Education under the State Council.

Chapter V Scholarships

32. The Chinese government establishes Chinese government scholarships for international students receiving higher education and encourages local people's governments to establish international student scholarships.

The measures for the administration of Chinese government scholarships shall be formulated by the relevant administrative departments under the State Council.

33 .The administrative department of Education under the State Council shall, on a merit based basis, entrust institutions of higher learning to train students with scholarships awarded by the Chinese government. Institutions of higher learning undertaking the task of cultivating Chinese government scholarship students shall give priority to recruiting Chinese government scholarship students.

34. Institutions of higher learning may establish scholarships for international students. Enterprises and institutions, social organizations, other social organizations and individuals are encouraged to establish international student scholarships, but unreasonable conditions shall not be attached.

Chapter VI social management

35 .Foreigners who apply to study in the schools referred to in Article 2 of these Measures shall, before entering the country, apply to the Chinese embassies and consulates stationed in their country of nationality or residence or other institutions stationed abroad entrusted by the Ministry of foreign affairs for X1 or x2 visa according to their study period, and submit the certificate filed by the competent education department and the admission notice issued by the school and other relevant materials in accordance with the regulations.

36. If the study visa held by an international student indicates that he needs to apply for a residence certificate after entering the country, he shall apply to the exit Entry Administration Department of the public security organ in the place where he intends to stay for a study Alien Residence Certificate within30days from the date of entry.

37. If the Ministry of foreign affairs has other provisions on the application of personnel of foreign diplomatic missions, consulates and representative offices of international organizations in China and their accompanying family members to study in schools, the provisions of the Ministry of Foreign Affairs shall prevail. The school shall not recruit students who fail to go through relevant procedures as required.

38. When recruiting an international student under the age of 18 and whose parents are not resident in China, the school shall require his parents to formally entrust a foreigner or Chinese resident in China as the guardian of the international student, and provide relevant supporting materials.

The school may accept international students who study in groups for a short time, but shall sign an agreement with the foreign sending unit in advance. If a school implementing primary and secondary education accepts international students in the form of groups for short-term study, the foreign sending unit shall go through the legal procedures required for organizing the entry and exit of minors in advance in accordance with the laws of the country where it is located, and shall send personnel to accompanythegroup and act as the guardian of international students during their study in the school.

39 .Upon admission, international students shall go through the confirmation procedures of the foreigner's physical examination record or undergo physical examination at the Chinese health and quarantine department in accordance with the provisions of the Chinese administrative department of health. It is confirmed by physical examination that serious mental disorders, infectious tuberculosis or other infectious diseases that may cause serious harm to public health are stipulated in the law of the People's Republic of China on exit and entry administration.

40. The school implements the all staff insurance system for international students. International students must apply for insurance in accordance with relevant national regulations and school requirements. Those who fail to purchase insurance in accordance with the regulations shall be insured within a time limit. If they fail to do so within the time limit, the school will not accept them; Those who have studied in school shall drop out or not be registered.

Chapter VII Supervision and Administration

41 .The administrative department of Education under the State Council shall establish and improve the quality supervision system for the training of international students. The education administrative departments of provinces, autonomous regions and municipalities directly under the central government shall supervise the training of international students in their respective administrative regions.

42. The administrative departments of education, public security and foreign affairs under the State Council responsible for the management of international students shall use modern information technology to establish an international student information management system, promote the working mechanism of information sharing, and constantly improve the management and service of international students.

43. International students who violate the provisions of the law of the people's Republic of China on the administration of exit and entry, the law of the people's Republic of China on administrative penalties for public security, the regulations of the people's Republic of China on the administration of entry and exit of foreigners, the provisions of the people's Republic of China on the administration of religious activities of foreigners within the territory of the people's Republic of China and other laws and regulations shall be dealt with by the public security and other competent departments according to law.

44. If an institution of higher learning commits any of the following acts in the process of recruiting and cultivating international students, the competent administrative department of education shall order it to make rectification, investigate its legal responsibility in accordance with the relevant provisions of the education law of the people's Republic of China, and may restrict its enrollment of international students:

(1)Enrolling students in violation of state regulations and school enrollment regulations;

(2)There is profit-making behavior in the process of enrollment;

(3)Failing to disclose the charging items and standards and failing to charge according to the items and standards;

(4)Issuing degree certificates, academic certificates or other academic certificates in violation of regulations;

(5)Poor teaching quality or inadequate management and service, resulting in adverse social impact;

(6)Other violations of laws and regulations.

Chapter VIII supplementary provisions

45. for the purposes of these measures, short-term study refers to studying in Chinese schools for no more than 180 days (inclusive), and long-term study refers to studying in Chinese schools for more than 180 days.

46 .These Measures shall apply to the recruitment of international students by scientific research institutions approved to undertake the task of postgraduate education in China.

These Measures shall apply mutatis mutandis to the recruitment of international students by educational institutions implementing nonacademic education approved by the administrative department of education.

The recruitment, training and administration of students from the Hong Kong Special Administrative Region, the Macao Special Administrative Region and Taiwan, as well as the recruitment, training and administration of schools for the children of foreigners in China, shall be implemented in accordance with other relevant provisions of the state.

47. The education, foreign affairs, public security and other departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government shall formulate administrative provisions of their own provinces, autonomous regions and municipalities directly under the central government in accordance with these measures.

48. These Measures shall come into force as of July 1, 2017. The regulations on the administration of the acceptance of foreign students by colleges and universities issued by the Ministry of education, the Ministry of foreign affairs and the Ministry of public security on January 31, 2000 and the Interim Measures for the administration of the acceptance of foreign students in primary and secondary schools issued by the Ministry of education on July 21, 1999 shall be repealed at the same time.
