Chapter I General Provisions

Article 1 These Provisions are formulated in accordance with the education law of the people's Republic of China, the higher education law of the people's Republic of China and the law of the people's Republic of China on the administration of the entry and exit of foreigners in order to enhance understanding and friendship between China and the peoples of the world, promote international exchanges and cooperation among colleges and universities, and strengthen the standardized management of the acceptance and training of foreign students.

Article 2 The term "institutions of higher learning" as mentioned in these Provisions refers to ordinary institutions of higher learning that implement full-time higher academic education approved by the Ministry of education; The term "foreign students" as mentioned in these Provisions refers to foreign citizens who hold foreign passports and register in Chinese colleges and universities to receive academic education or non academic education.

Article 3 Institutions of higher learning shall follow the policy of "deepening reform, strengthening management, ensuring quality, and actively and steadily developing" in accepting and cultivating foreign students.

Article 4 Institutions of higher learning that accept foreign students shall have the necessary teaching and living conditions, as well as the corresponding level of teaching, scientific research and management.

Article 5 When accepting and cultivating foreign students, colleges and universities shall follow the state's diplomatic policies and safeguard state sovereignty, security and social and public interests.

Chapter II Management System

Article 6 The Ministry of education is responsible for the overall management of the national work of studying in China, formulating guidelines and policies for the acceptance of foreign students, centrally managing the "Chinese Government Scholarships", coordinating and guiding the acceptance of foreign students in various regions and schools, and evaluating the management of foreign students and the quality of education in various regions and schools. The Ministry of education entrusts the national study abroad fund management committee to be responsible for the enrollment and specific management of foreign students within the national plan.

Article 7 The acceptance of foreign students by institutions of higher learning shall be examined and approved by the education administrative departments of provinces, autonomous regions and municipalities directly under the central government in conjunction with the foreign affairs and public security departments at the same level, and shall be reported to the Ministry of education for the record. The acceptance of foreign students who enjoy Chinese government scholarships by institutions of higher learning shall be subject to the examination and approval of the Ministry of education.

Article 8 The education administrative departments of provinces, autonomous regions and municipalities directly under the central government shall be responsible for the coordination and administration of the acceptance of foreign students by institutions of higher learning in their respective regions. Foreign affairs, public security and other relevant departments shall assist the administrative department of education and colleges and universities in the management of foreign students.

Article 9 Institutions of higher learning are specifically responsible for the enrollment, education, teaching and daily management of foreign students. The school shall have leaders at the school level in charge of the work of foreign students in the school; The University shall establish a foreign student management system in accordance with relevant regulations, and set up a centralized management organization or management personnel for foreign student affairs.

Chapter III categories, enrollment and admission of foreign students

Article 10 institutions of higher learning may provide academic education and non academic education for foreign students. The categories of academic education are: junior college students, undergraduates, postgraduates and doctoral students; The categories of non academic education are: advanced students and research scholars.

Article 11 Institutions of higher learning shall formulate measures for the enrollment of foreign students, publish the enrollment articles of association, and recruit foreign students in accordance with the provisions.

Article 12 The number of foreign students admitted by institutions of higher learning shall not be limited by the indicators of the national enrollment plan.

Article 13 Institutions of higher learning shall determine and publish the charging items and standards for foreign students in accordance with the relevant provisions of the state, and charge fees in RMB.

Article 14 The majors of foreign students accepted by institutions of higher learning shall be those open to the outside world. The establishment of a new academic education major for foreign students must be reported to the Ministry of education for examination and approval.

Article 15 Foreign citizens applying for study and further education in Institutions of higher learning in China shall have corresponding qualifications, meet the admission conditions, and have reliable financial guarantee and guarantor of affairs in China.

Article 16 Institutions of higher learning shall conduct admission qualification examination, examination or examination for students applying to come to China. Admission criteria are determined by the school itself. Those who use Chinese to receive academic education shall take a Chinese proficiency test.

Article 17 The admission of foreign students shall be decided by institutions of higher learning. Institutions of higher learning shall give priority to the admission of foreign students enrolled in the national plan; Institutions of higher learning may recruit foreign students for inter school exchanges and foreign students at their own expense.

Article 18 An institution of higher learning may accept foreign students admitted or transferred by other institutions, but it shall obtain the consent of the original accepting institution in advance.

Chapter IV scholarship system

Article 19 The Chinese government establishes "Chinese Government Scholarships" for foreign students to study in China.

The categories of "Chinese Government Scholarships" include: Undergraduate Scholarships, Graduate Scholarships and further study scholarships.

The Ministry of education shall set up other special research or training scholarships as needed.

Article 20 The Ministry of education shall formulate an enrollment plan for foreign students who enjoy Chinese government scholarships in accordance with the agreements signed between the Chinese government and foreign governments and the needs of exchanges between China and foreign countries.

Article 21 Foreign students who are eligible to study in China shall enjoy the scholarship granted by the Chinese government. The evaluation work shall be carried out by colleges and universities in accordance with relevant regulations. Foreign students who fail to pass the evaluation will be suspended or disqualified from enjoying Chinese government scholarships in accordance with the regulations.

Article 22 Local people's governments and institutions of higher learning may establish scholarships for foreign students individually or jointly as needed. Chinese and foreign enterprises, institutions, social organizations and other social organizations and individuals may also establish scholarships for foreign students with the consent of institutions of higher learning and provincial education departments, but shall not attach unreasonable conditions.

Chapter V teaching management

Article 23 Institutions of higher learning shall arrange the study of foreign students in accordance with the unified teaching plan of the University, and carry out educational and teaching activities in combination with the psychological and cultural characteristics of foreign students. On the premise of ensuring the teaching quality, the compulsory and elective courses of foreign students can be adjusted appropriately.

Article 24 Chinese and the general situation of China shall be compulsory courses for foreign students receiving academic education; Political theory should be a compulsory course for foreign students majoring in philosophy, political science and economics. Foreign students of other majors can apply for exemption.

Article 25 Chinese is the basic teaching language for colleges and universities to train foreign students. For foreign students whose Chinese proficiency fails to meet the professional learning requirements, the school shall provide necessary conditions for Chinese tutoring.

Colleges and universities may, according to their conditions, offer professional courses for foreign students to teach in English and other foreign languages. For foreign students receiving academic education in a foreign language, the abstract of their graduation thesis shall be written in Chinese.

Article 26 Institutions of higher learning shall organize foreign students to carry out teaching practice and social practice together with Chinese students in school according to the teaching plan; However, when choosing the place of internship or practice, relevant foreign-related provisions shall be observed.

Article 27 Institutions of higher learning shall, in accordance with teaching needs, provide necessary learning conditions for foreign students. Foreign students who use other equipment and obtain other materials outside the teaching plan shall submit an application, which shall be examined and approved by the school in accordance with relevant regulations and procedures.

Article 28 Institutions of higher learning shall manage the student status of foreign students in accordance with the relevant provisions of the state. When an institution of higher learning orders foreign students to drop out of school or expel them from school, it shall report to the provincial education administrative department for the record; If the person subject to the above punishment is a foreign student enrolled in the national plan, the University shall also notify the state study abroad fund management committee in writing.

Article 29 The University shall issue graduation certificates (completion certificates, completion certificates) or realistic academic certificates to foreign students in accordance with relevant regulations, and issue degree certificates to foreign students who have obtained degrees. The school can provide the foreign language translation of the above certificate as needed.

Chapter VI School Management

Article 30 Institutions of higher learning shall educate and administer foreign students in accordance with the relevant laws and regulations of the state and the rules and regulations of the University. The school shall educate foreign students to abide by China's laws and regulations and the rules, regulations and disciplines of the school, and respect China's social morality and customs.

Article 31 Colleges and universities generally do not organize foreign students to participate in political activities, but can organize foreign students to voluntarily participate in public welfare labor and other activities.

Article 32 Institutions of higher learning shall allow and encourage foreign students to participate in cultural and sports activities organized by the student union of the University; Foreign students can also voluntarily participate in celebrations held on major festivals in China; In cities or regions where foreign students are concentrated, relevant departments and schools shall hold recreational and sports activities beneficial to physical and mental health for foreign students.

With the approval of the University, foreign students can set up friendship groups in the University, carry out activities within the scope prescribed by China's laws and regulations, and obey the leadership and management of the University. Foreign students should apply to the competent authorities of the Chinese government for the establishment of Cross School and cross regional organizations.

Article 33 Institutions of higher learning shall respect the national customs and religious beliefs of foreign students, but shall not provide places for religious ceremonies. Missionary and religious gatherings are strictly prohibited in the school.

Article 34 With the approval of colleges and universities, foreign students may hold activities to celebrate important traditional festivals of their own country in the designated places and areas of the University, but they shall not have words and deeds that oppose or attack other countries or violate public morality.

Article 35 Institutions of higher learning shall provide necessary living service facilities such as accommodation for foreign students, and establish and publish the management system for the use of service facilities in accordance with relevant regulations.

Article 36 Foreign students may not be employed, engaged in business or engage in other business activities during their study in school, but may participate in work study activities in accordance with the regulations of the school.

Chapter VII social management

Article 37 The social management of foreign students shall be the responsibility of the relevant administrative departments. Institutions of higher learning shall cooperate with relevant administrative departments to do a good job in the social management of foreign students.

Article 38 Foreign students may stay off campus, but they shall go through the registration formalities with the public security organ in their place of residence in accordance with the regulations.

Article 39 The relevant departments shall provide convenience for the normal study and social practice activities of foreign students, and the charging standard shall be the same as that of Chinese students.

Article 40 Foreign students shall abide by the provisions of the relevant laws and regulations of our country when engaging in publishing, association, assembly, procession, demonstration and other activities within the territory of our country. Foreign students who conduct religious activities in China must abide by the provisions of the people's Republic of China on the administration of foreign religious activities.

Article 41 Articles carried or mailed by foreign students into or out of China shall comply with the relevant administrative regulations of China.

Chapter VIII entry exit and residence procedures

Article 42 Foreign students shall generally go through the study registration formalities with an ordinary passport and an "X" or "F" visa. Those who have been studying in China for more than six months shall apply for an "X" visa with the Chinese visa authority stationed abroad on the strength of the "visa application form for foreign students in China" (JW201 or JW202 form), the school's "admission notice" and the "foreigner physical examination record"; Those who come to China to study for less than six months shall apply for an "F" visa from the Chinese visa authorities abroad on the strength of the "visa application form for foreign students in China" (form JW201 or JW202) and the school's "admission notice"; Short term overseas students who come to China in groups can also apply for an "F" group visa by virtue of the invitation letter and telegram of the authorized unit.

Article 43 Those who come to China with foreign diplomatic, official, official or special passports and Chinese diplomatic, official or courtesy visas who need to study or study in Colleges and universities shall submit an application to the foreign affairs department at the provincial and ministerial level of China on the strength of a note issued by their foreign affairs office stating that they waive their privileges and immunities during their study in China, After approval, apply for an "X" or "F" visa at the exit Entry Administration Department of the public security organ with the consent letter of the foreign affairs department; Holders of foreign diplomatic, official, official or special passports who come to China visa free according to bilateral agreements, if they need to study or study in Colleges and universities, they should change their ordinary passports and apply for an "X" or "F" visa at the entry-exit administration department of the public security organ; Those who come to China with an ordinary passport but not an "X" or "F" visa, if they need to study or study in Colleges and universities, should apply to the entry-exit administration department of the public security organ for a new "X" or "F" visa. When accepting the application of the above-mentioned personnel, the entry-exit administration department of foreign affairs and public security organs shall check the applicant's visa application form for foreign students in China (form JW201 or JW202), the school's admission notice and the foreigner's physical examination record.

Article 44 the family members of foreign students may apply to our embassy (consulate) abroad for an "L" visa to accompany their study in China by accepting the invitation letter of the school. The exit Entry Administration Department of the public security organ shall handle visa extension for the accompanying family members of foreign students by accepting the official letter from the school. The stay period of the accompanying family members in China shall not exceed the validity period of the residence permit of foreign students.

Article 45 After coming to China, foreign students studying for more than six months must go through the confirmation formalities of the foreigner's physical examination record at the health and quarantine department within the specified time limit. Those who cannot provide the physical examination record of foreigners must undergo a physical examination at the local health and quarantine department. Upon examination, those who are confirmed to have diseases that are not allowed to enter the country according to Chinese law shall leave the country and return home immediately.

Article 46 Foreign students who enter China with an "X" visa must apply to the entry-exit administration department of the local public security organ for an Alien Residence Permit within 30 days from the date of entry. During the semester, if there is any change in the items filled in the residence permit, you must go through the change procedures with the entry-exit administration department of the local public security organ within 10 days.

Article 47 When transferring to another city, foreign students should first go through the immigration procedures at the exit Entry Administration Department of the public security organ in the original place of residence. After arriving at the destination, you must go through the immigration formalities at the exit Entry Administration Department of the public security organ at the destination within 10 days.

Article 48 Foreign students who temporarily leave the country during the semester must go through the re-entry formalities before leaving the country. Those who still need to study or stay in China after the expiration of the visa or residence permit must go through the extension procedures before the expiration of the visa or residence permit.

Article 49 Foreign students studying abroad must leave the country within the prescribed time after graduation, completion, dropout or withdrawal. For foreign students who are ordered to drop out of school or expelled from school, the school shall timely notify the exit Entry Administration Department of the public security organ. The exit and Entry Administration Department of the public security organ shall confiscate his alien residence permit or shorten his stay in China according to law.

Chapter IX supplementary provisions

Article 50 The Ministry of education shall be responsible for examining and approving the acceptance of foreign students by educational institutions other than ordinary institutions of higher learning that implement full-time higher diploma education, and the relevant administrative measures shall be formulated separately.
